Vulnerable Road Users

Vulnerable road users should enjoy enhanced protection under the law.  There should be stronger penalties imposed for motoring offences involving vulnerable road users.

Why the contribution is important

Often vulnerable road users experience life changing injuries or loss when they are the victims of motoring offences, and the law should recognise this and hold motorists accountable if they are proved to be at fault.

    Presumed liability would cover this. Summary:

    Presumed liability in civil law is the proper approach for a mature, socially conscious nation as it addresses the unacceptable human cost of the current system.

    To the best of our knowledge, the UK is one of only five countries in Europe that does not operate a strict liability regime for road users.

    Under presumed liability, injured vulnerable road users are properly and promptly cared for and not forced to fight for compensation.

    Presumed liability builds a culture of mutual respect between road users (as seen by the Continental example).
